Terms of Service
These Terms of Service (“Terms”) govern your access to and use of FormWire (the “Service”). By creating an account or using the Service you agree to these Terms.
The Service
FormWire receives HTTP form submissions on your behalf, stores them, and delivers them to email addresses you have verified and to any integrations you enable. We aim for high availability but the Service is provided “as is”. We do not guarantee uninterrupted operation or that every email will be delivered by downstream mail providers.
Accounts
You must provide a valid email address and keep your account credentials secure; you are responsible for activity under your account. You must be at least 16 years old to use the Service. You may close your account at any time, after which your data is deleted in line with our Privacy Policy.
Acceptable use
You agree not to use the Service to:
- Send spam or unsolicited messages, or collect submissions from forms designed to deceive the people filling them in.
- Collect sensitive personal data (such as payment card numbers, government identifiers, or health information) through forms pointed at the Service.
- Violate any law, infringe anyone’s rights, distribute malware, or attempt to disrupt or gain unauthorised access to the Service or other accounts.
- Resell the Service or circumvent plan limits (for example by pooling many websites through accounts intended for one user).
We may suspend or terminate accounts that violate these rules, with notice where practical. We may also throttle or reject traffic that threatens the integrity of the Service for other users.
Plans, billing & limits
Free plans are free indefinitely, subject to the published submission limits. Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled; when you cancel, your plan remains active until the end of the paid period. Submissions beyond your plan’s monthly limit may be rejected. We may change pricing with at least 30 days’ notice. Changes never apply retroactively to an already-paid period.
Your data
Submissions received through your forms belong to you. You grant us the limited rights needed to operate the Service: storing, processing, and delivering that data as you configure. You are responsible for your own compliance with the laws that apply to the data you collect (including having a privacy policy on your own website where required).
Liability
To the maximum extent permitted by law, FormWire’s total liability arising from the Service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential losses, including lost profits, lost data, or missed opportunities arising from undelivered submissions.
Changes to these Terms
We may update these Terms from time to time. We will post changes on this page and update the date above; material changes will be announced by email to account holders. Continuing to use the Service after changes take effect constitutes acceptance.
